Welcome to Leisure Space Furniture. These Terms of Service ("Terms") govern your access to and use of this website, store, and all related information, content, features, tools, products, and services (collectively, the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you.

By accessing or using any part of the Services, you agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and any other policies referenced on our website. If you do not agree to these Terms, please do not use the Services.

1. Eligibility and Account

By using the Services, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for your minor dependents to use the Services on devices you own or manage.

To use certain features of the Services, including placing an order or requesting an invoice, you may be asked to provide your name, email address, billing information, payment information, shipping address, and phone number. You represent and warrant that all information you provide is accurate, current, complete, and lawfully provided.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not assign, transfer, or share your account with any other person.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time, subject to applicable law.

You understand that your content, excluding payment information, may be transferred unencrypted and may involve transmissions over various networks or changes to conform and adapt to technical requirements of connecting devices or networks. Payment information is encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our prior written permission.

3. Product Information and Representation

We make reasonable efforts to display product descriptions, finishes, materials, colors, and images as accurately as possible. Product images depict style, color, and texture only. Actual products may vary from what appears online due to screen settings, device displays, lighting, batch variations, supplier updates, and manufacturing tolerances.

Many products feature natural materials, including solid wood, marble, stone, metal, rattan, linen, and genuine leather. Variations in grain, veining, texture, tone, markings, and other natural characteristics are inherent to these materials and are not considered defects.

All product descriptions, availability, and pricing are subject to change at any time without notice. We reserve the right to discontinue any product and to limit quantities sold to any person, household, geographic region, or jurisdiction on a case-by-case basis.

4. Orders, Invoices, and Acceptance

This website operates as a catalog and commerce platform. When you submit an order request, inquiry, or cart submission, you are making an offer to purchase. Orders are accepted only after we review the order, issue an invoice where applicable, receive payment, and confirm acceptance in writing. An order confirmation email, inquiry response, or cart submission does not necessarily constitute final acceptance of your order.

Because catalog information and supplier availability may vary, final sale status, special-order classification, and return eligibility may be determined by the issued invoice, supplier confirmation, and written approval from Leisure Space Furniture.

We reserve the right, in our sole discretion, to refuse, limit, cancel, or modify any order for any reason, including product unavailability, pricing errors, suspected fraud, suspected unauthorized activity, or issues identified with billing, shipping, or account information.

If we change or cancel an order, we may attempt to notify you using the email address, billing address, phone number, or other contact information provided at the time the order was placed.

You represent and warrant that purchases made through the Services are for your personal or household use only and not for resale, export, or other commercial distribution unless we expressly agree otherwise in writing.

5. Custom-Made, Personalized, Made-to-Order, and Special-Order Items

Some products sold by Leisure Space Furniture are custom-made, personalized, made-to-order, or special-order items.

Authorized Dealer for select Ashley products. For purposes of our policies, special-order items include products not stocked in our warehouse and ordered from a supplier specifically for your invoice. Such items are final sale and may not be canceled, returned, refunded, or exchanged once submitted to the supplier, entered into production, or otherwise committed for fulfillment, except where required by law or in cases of confirmed damage, defect, or shipment error.

6. Prices, Billing, and Taxes

All prices listed on the Services are in U.S. dollars unless otherwise stated. Prices, promotions, discounts, and product availability are subject to change without notice.

Unless expressly stated otherwise, posted prices do not include applicable taxes, shipping charges, handling fees, customs duties, import fees, white-glove service fees, assembly fees, or other governmental charges.

You agree to provide current, complete, and accurate purchase, billing, shipping, and payment information for all orders placed through the Services. You represent and warrant that:

  • the payment information you provide is accurate and complete;
  • you are authorized to use the selected payment method; and
  • you will pay all charges incurred by you, including applicable taxes, shipping, delivery, and service fees.

We reserve the right to correct any pricing, typographical, clerical, or other errors and to cancel or refuse orders arising from such errors, including after an order has been submitted.

7. Shipping, Delivery, and Inspection

Shipping and delivery dates are estimates only and are not guaranteed unless expressly stated otherwise. Delays may occur due to carrier operations, supplier processing times, weather, labor shortages, customs delays, supply chain disruptions, or other events beyond our reasonable control.

Initial order delivery is generally completed in 2 to 7 business days, subject to availability, scheduling, and delivery access.

Many larger products are shipped via LTL or other freight carriers. You are responsible for ensuring that the shipping address, contact information, and delivery access conditions you provide are accurate and complete, including gates, stairs, elevators, restricted access, and appointment requirements.

To the fullest extent permitted by law, title and risk of loss pass to you when the product is tendered to the carrier for delivery.

Inspection Upon Delivery: You are responsible for inspecting the packaging and product upon delivery. Any visible damage, concealed damage, missing parts, or delivery discrepancies should be reported to us promptly, preferably within 48 hours of delivery, together with clear photographs of the item, packaging, shipping label, and any visible damage.

8. Returns, Refunds, and Cancellations

Your purchase is also governed by our Refund Policy, which is incorporated into these Terms by reference.

Eligible returns require original packaging.

Please review our Refund Policy for important details regarding order cancellation eligibility, return eligibility and return windows, customer responsibility for return shipping, applicable restocking fees, final sale and non-returnable items, and refund review and processing timelines.

In the event of any conflict between these Terms and the Refund Policy regarding returns, refunds, or cancellations, the Refund Policy will control for those matters.

9. Intellectual Property

All content and materials available through the Services, including text, graphics, logos, icons, images, product descriptions, reviews, audio, video, page layouts, software, and the design, selection, and arrangement of the foregoing, are owned by or licensed to Leisure Space Furniture, its affiliates, licensors, or Shopify and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use only. You may not reproduce, duplicate, copy, sell, resell, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent.

10. Optional Tools and Third-Party Links

We may provide access to third-party tools, applications, integrations, or links that we do not monitor, control, or endorse. You acknowledge and agree that such tools and services are provided "as is" and "as available" without warranties, representations, or conditions of any kind.

Your use of any optional third-party tools or third-party websites is entirely at your own risk and is subject to the applicable third party's terms and policies. We are not responsible for examining or evaluating the content, accuracy, or practices of any third party and shall not be liable for any third-party materials, products, or services.

11. Relationship with Shopify

Leisure Space Furniture is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Leisure Space Furniture. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sales between you and Leisure Space Furniture, including any injury, damage, or loss resulting from purchased products or services.

12. Privacy

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to the Shopify Consumer Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify may collect and process personal information about your access to and use of the Services in order to provide and improve the Services. Information you submit through the Services may be transmitted to and shared with Shopify and third parties who assist in the operation of the Services.

13. Reviews, Feedback, and User Submissions

If you submit reviews, testimonials, comments, photos, videos, suggestions, ideas, proposals, or other content ("Feedback"), you grant Leisure Space Furniture a perpetual, worldwide, sublicensable, transferable, royalty-free license to use, reproduce, modify, publish, distribute, display, and otherwise use such Feedback in any medium for any lawful purpose.

You represent and warrant that:

  • you own or control all rights to the Feedback you submit or otherwise have all necessary rights to grant the license above;
  • your Feedback is accurate and not misleading;
  • your Feedback does not violate any law or infringe the rights of any third party; and
  • your Feedback does not contain unlawful, defamatory, abusive, obscene, fraudulent, or malicious content.

We may, but are not obligated to, monitor, edit, remove, or refuse any Feedback at our sole discretion.

14. Errors, Inaccuracies, and Omissions

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to update information or cancel orders at any time without prior notice, including after you have submitted an order.

You may access and use the Services only for lawful purposes. You may not use the Services:

  • for any unlawful, fraudulent, or malicious purpose;
  • to violate any applicable law, rule, or regulation;

Any provisions that by their nature should survive termination will survive, including provisions relating to intellectual property, feedback, disclaimers, limitations of liability, indemnification, governing law, venue, and enforcement.

17. Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS AND CONTENT PROVIDED THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT AS EXPRESSLY STATED BY LEISURE SPACE FURNITURE OR AS REQUIRED BY APPLICABLE LAW.

TO THE FULLEST EXTENT PERMITTED BY LAW, LEISURE SPACE FURNITURE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not guarantee that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any defects will be corrected.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LEISURE SPACE FURNITURE, ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, LICENSORS, AND SHOPIFY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, BUSINESS INTERRUPTION, OR REPLACEMENT COSTS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THE SERVICES SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits any liability or consumer right that cannot be excluded or limited under applicable law.

19. Indemnification

You agree to indemnify, defend, and hold harmless Leisure Space Furniture, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, demands, damages, losses, liabilities, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • your breach of these Terms or any policy incorporated by reference;
  • your violation of any law or the rights of a third party; or
  • your misuse of the Services.

20. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.

21. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and any other policies posted on the Services, constitute the entire agreement between you and Leisure Space Furniture regarding your use of the Services and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, unless expressly stated otherwise.

22. Assignment

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. We may assign, transfer, or delegate these Terms or any of our rights and obligations at any time without notice to you.

23. Governing Law and Venue

These Terms and any dispute arising out of or relating to the Services or any purchase from Leisure Space Furniture shall be governed by and construed in accordance with the laws of the State of California and applicable federal law of the United States, without regard to conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms, the Services, or any purchase from Leisure Space Furniture shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction and venue of those courts.

24. Changes to These Terms

We reserve the right to update, change, or replace any part of these Terms at any time by posting revised Terms on this page. It is your responsibility to review this page periodically for changes.

Your continued use of the Services following the posting of changes constitutes your acceptance of those changes, to the fullest extent permitted by law.
